  SectionI Application for Stay Permit

  Article 1Under any of the following circumstances, foreigners may apply to the exit-entry administrations of public security organs under local people’s governments at or above the county level in the proposed places of residence for foreigners’ staypermits:

  1.Wherevisa-exempt foreignersneed to stay in China longer than the visa-free perioddue to non-diplomatic or official reasons;

  2.Foreign seamen and their accompanying family membersneed to leave the cities where the ports are located;

  3.Those who havebeen approved to withdraw from Chinese nationality and need to stay in China;

  4.Foreigners who need to enter China urgently for humanitarian reasons;

  5.Foreign infants born in Chinaand need to stay in China;

  6.Under other circumstances in which foreigners’ stay permits should be applied for, they shall apply for such permits in accordance with relevant regulations.

  Article 2 Documents Required

  When applying, applicants shall answer the public security inquiry and submitthe following documents:

  1.Both original and photo copy of valid passport and visa;

  2.Visa Application Form of the People’s Republic of China;

  3.Qualified photos of Visa in Hubei Province and its "check receipt";

  4.Valid Accommodation Registration Form for Foreign Nationalsin Yichang;

  5.Other materialsrelating to the purpose of application:

  (1)Visa-exempt foreignersshall submit proof materials relating to the stayof application;

  (2)Foreign seaman and their accompanying family members shallsubmitSeafarer's Passport or other international travel documents, the guarantee correspondence of the ship agency, a through ticket (air, road, rail or sea) to another country or region with the date and seat number on it, or other proof material relatingto stay of application;

  {C}(3){C}Those who withdraw their Chinese nationality in China shall submit The certificate of renunciation of nationalityof People’s Republic of Chinaand other proof material relatingto stay of application;

  {C}(4){C}Where the duration of stay needs to be extended, the visa holder shallsubmit theexpirationvisa and poof material (Such as certificate of employment from original work unit or graduation certificate or certificate of termination of study issued by the school, etc.)

  {C}(5){C}For foreign infants born in China, their parents shall submit their passports, valid visasand the infant’s birth certificates.

  6. Other materials deemed necessary by the public security offices

  SectionII Change of Stay Permit

  Where, after entry with a visa, a foreigner is unable to leave the country within the validity period of the stay certificate due to objective reasons, the applicant shall apply to the exit and entry administration authority of the public security organ of the local people’s government at or above the county level in the place of his or her stay for a change of visa. The application materials and replacement requirements shall be handled in accordance with the requirements of the application for residence documents.

  SectionIIIReissuingof Stay Permit

  Where the visa of a foreigner in China is lost, damaged, destroyed, stolen or robbed, the applicantshall, in a timely manner, apply to the exit and entry administration authority of the public security organ of the local people’s government at or above the county level in the place of his or her stay for reissuance of the visawith below materials:

  {C}(1){C}Visa Application Form of the People’s Republic of China;

  {C}(2){C}Qualified photos of Visa in Hubei Province and its "check receipt";

  {C}(3){C}Valid Accommodation Registration Form for Foreign Nationalsin Yichang;

  {C}(4){C}Other materialsrelating to the purpose of application:

  {C}a.{C}Where the visa of a foreigner in China is lost, stolen or robbed, the applicantshall submit the proof of passport loss or Note from Embassy and Consulate of applicant’s country in Chinaas well as new passport or other international travel documents.

  {C}b.{C}Where the visa of a foreigner in China is damagedor destroyed, the applicantshall submit the damaged passport or Note from Embassy and Consulate of applicant’s country in Chinaas well as new passport or other international travel documents.

  SectionIV Mattersof applyingfor, changing or reissuing of a residence permit, a foreigner shall.

  Article 1To apply for extension of a stay permit, a foreigner shall apply to the exit-entry administrations of public security organs 7 days before the expiry of the validity period of the visa or residence permit.

  To apply for an extension of a residence permit, a foreigner shall apply to the exit-entry administrations of public security organs 30 days before the expiry of the validity period of residence permit.

  The time limit for the processing of visa and stay permit is 7 working days, and the time limit for the processing of residence permit is 15 working days.

  Article 2Children under the age of 16 holding a foreign passport for the first time apply for a visa, stay permit and residence permit in Yichang City. They shall submit their own birth certificate, a copy of the foreign passport of foreign parent/parents, or a Chinese passport of Chinese parent/parents and a copy of the permanent residence (check the permanent residence certificate) for nationality identification.

  Article 3In accordance of Nationality Law of The People’s Republic of China, the people’s Republic of China does not recognize dual nationality for any Chinese national. Applicants who have joined foreign nationalities must apply for alien visa, stay permit, and residence permit after they have written off their Chinese household registration.

  Article 4Proofs of family member relationship and kinship, refer to the marriage certificate, birth certificate, adoption certificate, other family relationship certificate and related notarization issued by the competent authorities of China; the marriage certificate, birth certificate and kinship relationship issued by the embassies and consulates.

  Article 5Proof of changesin the marriage certificate, birth certificate, kinship certificate, name, etc. issued by foreign institutions shall be certified by the Chinese embassy or consulate in that country.

  Article 6 Relevant foreign documents shall be translated into Chinese by the domestic notary office.

  Article 7Foreigners, who apply for visas, stay permits, and residence permits, must pay fees in accordance with the relevant provisions of the competent departmentsof the Chinese government.

  Article 8 The validity and entry times of the application for visa, stay permit and residence permit shall be subject to the final decision of the exit-entry administrations of public security offices.

  Article 9 The final decision made by the exit-entry administrations of public security offices shall not issue extension, change or reissuingof general visa, a foreigner stay permit and extension of residence permit. The exit-entry administrations of public security organs have the right to revoke or annul the issued visa, stay permit and residence permit.

  Article 10 The public security officesshall punish the foreigners or persons responsible for illegal residence (stay) or having other illegal acts in China.
