A minivan with only 8 seats carried 15 people, 1 driver and 14 students. Wufeng police allowed the minivan driver to obtain a guarantor pending trial in accordance with the law. This case became the first one in Yichang, in which the driver would be given criminal sanctions due to the overloading and his dangerous driving.
On March 25, the Leping Traffic Police Detachment of Wufeng Traffic Police received a report that a minivan driving students to and from school is overloaded. After receiving the report, Wufeng police immediately began to inspect the under-administration road, and they found a Chang’an-brand small-sized minivan with the license number of E28**** on the rural road of Sanjiaomiao Village.
The police approached the vehicle and asked the driver to pull over for inspection. When opening the door, they were shocked that the 8-seat minivan took 15 people, 1 driver, 14 students. It exceeded 80% of the ratified number of passengers.
Wufeng police investigated that the driver bought this minivan in 2010 and put it in operation at the beginning of 2015. Since the increasing number of student passengers, he simply refitted the van to shuttle students to and from school in order to save costs.
Wufeng police also immediately criticized and educated the driver as well as the head of school, and initiated an investigation to the driver’s unlawful act of overloading passengers, who was suspected to engage in school bus service or passenger traffic according to related provisions in the Ninth Amendment to Criminal Law.
