Recently, the Housing and Urban-Rural Development Bureau and the Market Supervision Bureau of Yichang Municipality have jointly released a “Tripartite Contract Template for Construction and Installation of Elevators in Existing Residential Buildings” to regulate the installation of elevators in existing residential buildings.
The “Contract Template” clarifies the rights and obligations of the three parties involved during the elevator installation, including the residents of the building, the construction unit, and the elevator installation unit. It specifies the scope of commissioned services, standardizes the construction, installation, and acceptance processes, and provides reference standards for payment, quality warranty, and breach of contract liabilities.
“Residents can refer to the payment milestones in the ‘Contract Template’, and pay the corresponding contract fees according to the progress of the project. It is strongly suggested not to pay too much in advance. At the same time, it is necessary to know well about the relevant laws and regulations such as the ‘Building Law of the People's Republic of China’, the ‘Special Equipment Safety Law of the People's Republic of China’, the ‘Regulations on the Quality Management of Construction Projects’, and the ‘Regulations on the Safety Production Management of Construction Projects’,” said a staff member of the Housing and Urban-Rural Development Bureau.
The “Contract Template” is the first of its kind in Hubei province, which regulates the rights and obligations between residents and commissioned enterprises, creating a positive and healthy market environment and effectively protecting the rights and interests of residents.
